Council of Ministers approves draft agreement to regulate navigation in the Khor Abdullah between Iraq and Kuwait

Council of Ministers   decided at its regular fourth session held on Tuesday, January 29, 2013, to approve the issuance of a document leave subsequent negotiation and signing of the Minister of Transport on the draft agreement on the organization of maritime navigation in the Khawr Abd Allah between Iraq and Kuwait based on the provisions of articles (6 and 28) of the Law of Treaties No. (111) of 1979 amended with the Foreign Ministry to prepare a document leave subsequent behalf of the Government of the Republic of Iraq to the Minister of Transport in accordance with contexts approved for submission to the General Secretariat of the Council of Ministers for obtaining the signature of the President of the Council of Ministers as well as the approval of the draft law on ratification of the said Convention and forwarded to the House of Representatives based on to the provisions of articles (61 / I and item 80 / item II) of the Constitution.
      The government source said that the approval of the draft law on ratification of the Convention on the organization of maritime navigation in the Khawr Abd Allah comes sake of the Iraqi government to strengthen the bilateral relationship between the two countries and respect for human navigational headquarters in international charters and conventions and to support the maritime transport sector through the organization of maritime traffic in the Khawr Abdullah and the formation of a joint committee to activate and implement the provisions of this Agreement and the development of joint plans for maritime safety in the Khawr Abd Allah and other navigational and environmental issues.
      The source explained that the Foreign Ministry had asked in January 7, 2013 the                 Council of Ministers approved a draft law convention and the draft law of ratification and supported the legal department at the General Secretariat of the Council of Ministers in January 14, 2013 View Thread the Council has shown the Iraqi Foreign Ministry actions taken by the Kuwaiti side on the agreement, which was subject to the Kuwaiti Council of Ministers and the work is continuing and urgent to display on the Kuwaiti National Assembly.
The government source added that the agreement had stipulated not to raise any flag last for ships carrying the nationality of one Contracting Party is aware of their nationality during their passage through the territorial sea of the other party in the exercise of the right navigational As foreign vessels it would raise aware nationality only and does not apply the provisions of this agreement on the passage of warships     The Coast Guard for both parties, where each party will work to prevent hunters from being in the part located in the territorial sea of him from the waterway and the parties will cooperate to preserve the marine environment from the risk of contamination of any kind and work to combat and eliminate its effects.
      
The source indicated that the waterway mentioned in the agreement is the Fairway existing meeting point navigation channel in the Khawr Abd Allah international boundary between the two points border No. (156) and (157) towards the south to the point (162) then to the beginning of the entrance of navigation channel at entrance of  
 Khawr Abd Allah.

        The source  pointed out that the parties to the agreement will form the Management Committee of joint-chaired by Undersecretary of the Ministry of Transport on the Iraqi side and the Under Secretary of Transportation for the Kuwaiti side and the membership of an equal number of experts from both sides, where will this committee functions to organize and coordinate the navigation in the waterway in the Khawr Abd Allah and put down  a joint plan to ensure the safety of navigation in the waterway to approve maintenance like widening ,deepening and developing guidelines and hydrographic survey work and pick up drowned vessels  be this business equally between the parties to the agreement.

 The source added that this agreement came on the  basis of  the United Nations Convention on the Law of the Sea in 1982 and a commitment to UN Security Council Resolution No. (833) for the year 1993 on the international boundary between the two countries, especially on the subject of respect for the right navigational for both parties, where will this agreement into effect from the date of exchange of diplomatic notes official pro to authenticate the parties agreement by and diplomatically and in accordance with the constitutional procedures in both countries and will remain this agreement is valid for an indefinite period unless one of the parties to terminate and notify the other party officially before (6) months to be terminated with the consent of the contracting parties
